Abstract

The role that actors(states, international organizations and NGO’s), can play in fulfilling international human rights and also settlement of prospective modern punishment system is a key element in development of these issues. This fact that most of conflicts, wars and crimes appeared because of poverty and lack of knowledge and also avarice of some fearless people, are problems that demonstrate the vital role of such institutions in our desired world full of peace and justice. Although IHL is limited to the conflict period, but human rights are wide spread to whole our life aspects and essences. Where weapons accessibility is easier and cheaper than food, fulfillment of IHL in conflicts is impossible. Because violation of basic right of honorable life, throw-outs all humanities. What are the source of such shortages in some communities and who is the provider of such guns? Without any doubt big powers and organizations responsibility is not deniable. It results terrorism and human disasters by genocides in Africa, South and South-east Asia and Middle and Near East. Using their properties, developed countries have to pursue stable development in poor community that includes feeding methods and education facilities. On the other hand, some regional states meddle in neighbors riots and providing money, equipments and leadership to protect their sides in conflicts is of challenges of international criminal court. Interpretation of current laws by international criminal court in some ad-hoc cases to extend the legitimacy of court into such situations is admirable. Weakness of national courts in pursuing such criminals or their abstinence of doing so, makes such interfere unavoidable. Successful settlement of such system helps international community to develop peace, and warns regional malignances of strong international laws to stop their crimes. Here exerting power of this system by international organizations is necessary that requires protection of big states. Such
